SUMMING-UP (1)

Definition: A speech that the judge makes near the end of a trial in court in which he or she reminds the jury about the evidence and the most important points in the case before the jury makes its decision.

1. Purposeful and considered a necessity.

2. Made timely, after the prosecution and defence lawyers have closed their cases. (And after a friend of court, if any, desirous of speaking has been permitted to speak.)

3. Gives a comprehensive review of the case and speech contains no legalese. That is, jury members will not be confused by the wording of the judge's speech.

4. Contains a complete summary of the applicable laws and exceptions to a rule, if any, in respect of particular case.

5. Has no element of misdirection and is not an expression of his or her opinion or point of view or an adoption of a position.

6. Stresses or explains the consequences of the application of the law to the facts of each side; contains nothing extraneous, that was not heard or seen during trial, without expressly suggesting how the jury should interpret an issue.

7. Serves purpose(s), that is, helps in the decision-making process, whatever the final decision of jurors.
